The sentencing comes after a Travis County judge refused to grant him a new trial.

Perry is expected to be sentenced Tuesday for the murder of Garrett Foster. Gov. Greg Abbott has asked the Texas Board of Pardons and Paroles to review his conviction.

Daniel Perry’s attorneys said he acted in self defense when he shot and killed Garrett Foster, 28, after demonstrators banged on his car during a racial justice protest. He faces life in prison.

Daniel Perry has maintained that Foster, who was escorting his fiancée during a Black Lives Matter protest, pointed a weapon at him. His attorneys say he's been released on bond.

District Attorney José Garza will bring a case against Daniel Perry to a Travis County grand jury soon. Perry drove into a Black Lives Matter protest and fatally shot Foster last July.
